THIS IS A LIVE AUCTION WITH INTERNET BIDDING AVAILABLE.  On-Site auction takes place on Thursday, May 27, at 920 23rd Road NW, Choteau, Montana.  The auction begins at 10:00 a.m.  Rolling stock and equipment that is offered in the online catalog begins selling at approximately 12:00 Noon.

BUYER'S PREMIUM (Ranch Equipment Auction):

There will be 2.5% Buyer's Premium added to the winning bid price to arrive at the total contract price to be paid by the Buyer. Example: $10,000 final bid + 2.5% BP = $10,250 total sale price

PROCEDURE: Pre-bidding takes place ahead of auction day with increments as determined by the Auctioneer. Bidding starts at the nominal Opening Bid indicated and is open to the public. The Auctioneer is the sole arbiter and controller of the conduct of the auction and shall be the final and absolute authority without liability to any party.  Each lot will close in an open-cry live auction format.

BIDDER REGISTRATION: During the registration process, you must submit information found to be current, complete, and accurate for proper identification.  You acknowledge that it is your responsibility to continually maintain current and accurate account information. All bids are final and cannot be retracted or removed.  This online auction requires you to enter a valid credit card to register and bid. Your credit card will be checked for an available credit of $25.  Your card will not be charged at this time.

NO RESERVES, NO BUYBACKS, NO RETURNS: Each lot will sell to the highest bidder without reserve, unless noted otherwise. All sales are final. There are no returns, refunds, credit card charge-backs or adjustments.

CURRENCY TYPE: All bidding increments and payments will be in US Dollars (USD).

PAYMENT: At the end of the auction, all successful online bidders will receive an invoice via email. All invoices must be paid by 5 PM on Friday, May 28th, 2021. Shobe Auction accepts the following forms of payment:

3)Check with a valid driver’s license

4)Wire transfer, $20 convenience fee

5)All major credit cards, 3.3% convenience fee

a. Credit card information can be updated online in your account settings.

b. Credit cards declined for any reason will be charged a $30 processing fee to process another card.

No items may be removed until full payment is received by Shobe Auction. If you have a conflict with this payment period, you must pre-arrange payment with Shobe Auction.

REMOVAL:  Equipment must be removed within 10 days following auction. No items may be removed until full payment is received by Shobe Auction.  If you have a conflict with this removal period, you must pre-arrange removal with Shobe Auction.

YOUR BIDDING IS NOT CONTINGENT UPON FINANCING: Buyer must have financing arranged, if needed, and be capable of paying cash at closing.

POSSESSION: Merchandise becomes the FULL RESPONSIBILITY of the buyer at the close of the auction and the buyer assumes all risk of loss and damage to property at that time. In any such event, the bidder will still be responsible for payment for the original purchase and the costs of collection of this payment and/or damages resulting from the resale of the property.

AS-IS SALE: All lots sell as is, where is, with all faults. Shobe Auction & Realty, Inc. and the seller do not give or make any type of guarantee or warranty regarding the lots to be sold, implied or otherwise. Shobe Auction encourages all bidders to inspect lots in person before bidding. Shobe Auction is not responsible for incorrect listing information, if any. PROPERTY INSPECTION: Preview dates and times are listed on the auction “Preview” tab. Each potential bidder is responsible for conducting, at their own risk, independent inspections, investigations, inquiries, and due diligence concerning the property. Each potential bidder shall be liable for any damage caused by any such inspections or investigations.

MISCELLANEOUS: All decisions of the auctioneer are final as to the methods of bidding, disputes among bidders, increments of bidding and any other matters that may arise before, during, or after the auction. Seller reserves the right to deny any person the right to participate in the auction or to ban anyone from the auction who attempts to disrupt it.

BIDDER VERIFICATION: The identity of all bidders will be verified, bidding rights are provisional, and if complete verification is not possible, Shobe Auction & Realty will reject the registration, and bidding activity will be terminated.

DEBT COLLECTION AND INTEREST CHARGE: The bidder agrees to pay all reasonable attorney fees and other costs incurred by Shobe Auction & Realty in its efforts to collect unpaid funds from the bidder. The bidder agrees that a fee of 2% of the outstanding balance per month be added to any unpaid balance due Shobe Auction & Realty. Any debt collection or dispute proceedings will be heard in Fergus County, Montana.

LIMITATION OF LIABILITY: If, for any reason, Shobe Auction & Realty, is unable to make available or deliver any lot purchased, or portion thereof, or documentation required in respect to any lot, the sole liability of Shobe Auction & Realty, if any, will be the return of monies paid in respect to such purchase upon the lot’s return to Shobe Auction and Realty by buyer.

AGE REQUIREMENT: All bidders must be 18 years of age or older.
